Como es sabido, la legalización del matrimonio entre ciudadanos del mismo sexo en 2005 suscitó en nuestro país uno de los debates constitucionales más trascendentes de los últimos años. La doctrina española se posicionó a favor y en contra de la constitucionalidad de la Ley 13/2005. Recientemente, la STC 198/2012 ha venido a zanjar el debate. El Tribunal Constitucional ha avalado la constitucionalidad del matrimonio homosexual, pero introduciendo matices y salvedades significativas en cuanto a su consideración jurídico-constitucional. El presente trabajo enjuicia la STC 198/2012 en el contexto del debate más amplio que en torno a la apertura del matrimonio a las uniones homosexuales está hoy planteado a nivel mundial. The legalization of same-sex marriage in Act 13/2005 sparked in our country one of the most important constitutional debates of recent years. Some authors supported the constitutionality of the Act; other authors questioned this constitutionality. The debate has been recently settled by the Spanish Constitutional Court (STC 198/2012). Spain´s Constitutional Court upheld the constitutionality of gay marriage. This paper analyzes the decision of the Spanish Constitutional Court in the context of the global debate over same-sex marriage.
